Painter Website Pros is a specialized website-design brand operated by Evergreen Web Solutions. Evergreen Web Solutions is owned by Riley Vincent.

These Terms & Conditions govern your use of the Painter Website Pros website and your interactions with the Free Full Website Preview offer, website-design services, hosting, website management, and related services.

References to “Painter Website Pros,” “Evergreen Web Solutions,” “we,” “us,” and “our” mean the business operating this website and delivering the related services.

By using this website, submitting a form, requesting a Free Full Website Preview, accepting a proposal, paying an invoice, purchasing a package, or using hosting or website-management services, you agree to the terms that apply to your use of the website or services.

Project-specific proposals, invoices, service agreements, email approvals, or written contracts may include additional terms. If a signed project-specific agreement directly conflicts with these general Terms & Conditions, the project-specific agreement controls for that project.

1. Acceptance of These Terms

Visitors and customers agree to these Terms & Conditions when they use the website, submit a form, request a Free Full Website Preview, approve a proposal, pay an invoice, purchase a website package, or use hosting or website-management services.

Basic website-use terms apply when you visit or use the website. Project-specific obligations begin when you accept a proposal, approve a project, pay an invoice, purchase a package, or otherwise agree to move forward with services.

If you do not agree with these Terms & Conditions, you should not submit information, request a preview, purchase services, or use the website in a way that requires your agreement.

2. Eligibility and Business Use

This website and our services are intended for adults and business owners.

By submitting a request or purchasing services, you represent that you are at least 18 years old.

If you submit information on behalf of a painting company or another business, you represent that you are authorized to provide that information, request services, make project decisions, and communicate on behalf of that business.

Painter Website Pros primarily provides services to businesses operating in the United States.

3. Free Full Website Preview

Painter Website Pros may offer a Free Full Website Preview to eligible painting contractors.

No payment is required to request or review the initial Free Full Website Preview. Requesting a preview does not obligate your painting company to buy a website.

The Free Full Website Preview is a private preview prepared to show a possible website direction for your business. It may be created using submitted information, public business information, stock materials, placeholder content, draft copy, sample images, design templates, or other reasonably available resources.

The preview is not normally published as your company’s live website. It is not a completed deliverable, finished website, public website launch, or guaranteed final design.

A preview may contain draft copy, placeholder content, incomplete information, sample images, temporary sections, or features that require additional setup before launch.

Painter Website Pros may accept or decline a preview request at its discretion. Submitting a request does not guarantee that a preview will be created.

Unless separately confirmed in writing, no specific delivery date is guaranteed for a Free Full Website Preview.

Preview access is provided only for evaluation. You may not copy, publish, transfer, recreate, screenshot for commercial use, or use the preview commercially without written permission or purchase.

The offer should always be understood as a Free Full Website Preview, not a free website, free completed site, or free launched website.

4. No Obligation and No Automatic Purchase

Reviewing a Free Full Website Preview does not create a purchase obligation.

You do not become responsible for a website package merely by submitting the preview form or reviewing the preview.

Paid work begins only after you select a package and accept the applicable proposal, invoice, service agreement, or written project approval.

If you decide not to move forward after reviewing the preview, you are not required to purchase the website.

5. Website Packages and Scope

Painter Website Pros offers several website package options. The final proposal or invoice defines the actual package, scope, deliverables, and pricing for your project.

Professional Template Website

Professional Template Websites start at $1,499.

This package is built using a professionally designed template and generally includes a five-page website scope, depending on the final offer and project details.

The Professional Template Website includes one formal revision round after payment and requires hosting after launch. Standard hosting starts at $75 per month.

Semi-Custom Website

Semi-Custom Websites start at $2,500.

This package may include up to eight pages, more layout flexibility, greater design customization, and two formal revision rounds after payment.

The Semi-Custom Website requires hosting after launch. Standard hosting starts at $75 per month.

Fully Custom Website

Fully Custom Websites are quoted individually.

The scope, pages, functionality, revision policy, schedule, and pricing for a fully custom website are established in a separate proposal, invoice, or written agreement.

“Starts at” pricing is not a guarantee that every project will qualify for the minimum price.

Additional charges may apply for extra pages, advanced forms, scheduling systems, e-commerce features, membership features, custom integrations, large copywriting projects, advanced animations, logo design, additional revision rounds, rush requests, third-party services, specialized functionality, or significant changes in project scope.

6. Proposals, Invoices, and Project Agreements

Project details may be provided through a proposal, invoice, email approval, service agreement, or another written project document.

You are responsible for reviewing the project scope, deliverables, pricing, payment due dates, hosting terms, and any restrictions before paying an invoice or approving a project.

Paying an invoice, electronically accepting a proposal, approving work by email, or otherwise confirming that you want to move forward may indicate acceptance of the project terms.

Project-specific documents may include additional pricing, deliverables, deadlines, package details, revision terms, restrictions, or responsibilities.

If a project-specific signed agreement directly conflicts with these general Terms & Conditions, the signed project-specific agreement controls for that project.

7. Payments

Payment amounts and due dates appear on the applicable proposal, invoice, or written agreement.

Work may not begin until the required initial payment is received.

Final files, launch access, domain connection, website publication, or other deliverables may be withheld until required payments are received.

Hosting and recurring services are invoiced according to the selected plan or agreement.

Customers are responsible for reviewing invoices and paying them by the stated due date.

Electronic payments are processed by the payment or invoicing provider identified on the invoice or payment page. Painter Website Pros does not receive or store complete payment-card numbers.

8. Refunds

The Free Full Website Preview does not require payment.

Once a paid project begins, fees compensate Painter Website Pros for reserved time, design work, setup, research, copywriting, planning, communication, and production already performed.

Payments for completed work are not refundable.

Refund eligibility for incomplete work, if any, is determined by the applicable proposal, agreement, project stage, and work already completed.

Third-party fees, domain purchases, platform charges, software subscriptions, processing fees, and completed custom work are generally not refundable.

Canceling a project does not eliminate payment obligations for work already completed, approved expenses already incurred, or fees already due under the applicable proposal, invoice, or agreement.

9. Customer Responsibilities

Customers are responsible for providing accurate and timely information, materials, access, feedback, and approvals.

This may include:

  • Company information
  • Contact details
  • Service descriptions
  • Service areas
  • Licensing information
  • Insurance statements
  • Warranty statements
  • Logos
  • Project photographs
  • Reviews
  • Staff information
  • Approval decisions
  • Domain access
  • Third-party account access

Delays in providing materials, access credentials, feedback, approvals, or payments may delay the project.

Customers are also responsible for reviewing the website before launch and identifying incorrect contact information, incorrect pricing, incorrect service details, misspellings, unsupported claims, outdated licensing information, incorrect warranties, image issues, legal concerns, or regulatory concerns.

Painter Website Pros may assist with drafting and website planning, but the client remains responsible for confirming that business-specific claims are accurate.

10. Rights to Customer-Supplied Materials

Customers retain ownership of materials they already own, such as logos, original project photos, existing brand materials, original business copy, trademarks, and customer-provided graphics.

By submitting materials to Painter Website Pros, you grant us permission to review, edit, resize, format, place, store, and use those materials as reasonably necessary to prepare a preview, build a purchased website, provide services, complete revisions, and support the project.

You represent that you have the legal right and permission to use any materials you submit.

You should not submit copyrighted images copied without permission, competitors’ website copy, confidential customer records, private information visible in project photos, logos or trademarks you do not own, false reviews, or misleading licenses, certifications, awards, or business claims.

11. Stock Images and Third-Party Materials

Projects may use licensed stock photography, icons, fonts, plugins, integrations, platform components, embedded maps, review widgets, or other third-party resources.

Third-party materials remain subject to their own licenses, restrictions, and terms.

A client does not receive ownership of third-party software, stock libraries, fonts, platform technology, plugins, integrations, or other resources owned by third parties.

Some services may require separate subscriptions, ongoing fees, or separate third-party accounts.

Third-party providers can change pricing, update policies, discontinue products, restrict access, modify features, or experience outages. Painter Website Pros does not control independent third-party platforms.

12. Draft Content and Copywriting

Website copy may be drafted from information supplied by the customer, public business information, research, project goals, service details, and AI-assisted tools.

Draft copy is provided for customer review.

The customer must confirm that claims about experience, licenses, warranties, prices, services, service areas, locations, results, and qualifications are accurate before the website is launched.

Painter Website Pros is not responsible for inaccurate information that the customer supplies, approves, or fails to correct after being given a reasonable opportunity to review it.

Website copy should not be treated as legal, tax, licensing, insurance, or regulatory advice.

13. Revisions

The Free Full Website Preview is intended to demonstrate the proposed website direction.

Formal revision rounds begin after the customer purchases a package.

The Professional Template Website includes one formal revision round.

The Semi-Custom Website includes two formal revision rounds.

Fully Custom revision terms are defined in the proposal or agreement.

A revision round means one organized set of requested changes submitted together.

Unused revisions do not create a cash credit, refund, discount, or future revision bank.

Additional revisions may require an additional quote.

A complete redesign, new creative direction, major scope change, request for additional pages, significant copy expansion, custom functionality request, or change outside the approved package scope may not count as a normal revision.

Requests made after approval or launch may be billed as website-management work or as a separate project.

Customers should provide revision feedback in one organized list rather than through scattered texts, emails, calls, or messages.

14. Project Timelines and Delays

Project timelines depend on package scope, client responsiveness, revision volume, content availability, technical requirements, payment timing, and third-party services.

Any estimated completion date is a good-faith estimate unless expressly guaranteed in a signed agreement.

Delays caused by missing content, missing access credentials, delayed approvals, unpaid invoices, unclear feedback, or late client communication may move the timeline.

Painter Website Pros is not responsible for delays caused by hosting companies, registrars, software platforms, outages, approval processes, technical issues, or events outside its reasonable control.

15. Approval and Website Launch

The customer is given an opportunity to review the website before launch.

Approval may be provided by email, written message, proposal system, invoice system, project system, or another documented method.

The customer is responsible for reviewing important business information before approval, including contact details, services, photos, licensing statements, warranties, service areas, and calls to action.

Once the customer approves the website, Painter Website Pros may connect the domain and publish the website.

Changes requested after final approval may be treated as post-launch edits, website-management work, or a separate project.

Search engine indexing and visibility may take time after launch. Painter Website Pros does not guarantee immediate indexing, rankings, traffic, calls, or leads.

16. Domain Names

The domain belongs to the client.

Customers should own and control their domain registration.

Painter Website Pros may assist with domain registration, domain connection, DNS changes, or domain transfer when included in the project scope or separately approved.

The customer is responsible for domain renewal fees unless a written agreement states otherwise.

The customer must maintain accurate contact information for the registrar, account access, and payment information.

Painter Website Pros is not responsible for a domain that expires, is suspended, or becomes unavailable because the customer did not renew it, maintain valid payment information, respond to registrar requests, or keep control of the domain account.

Domain transfers can be subject to registrar rules, waiting periods, verification, account access, security restrictions, and third-party policies.

A domain name and the underlying website platform are separate assets.

17. Website Ownership and Intellectual Property

Customers retain ownership of their domain, company name, logo, original photos, original business materials, trademarks, and other content they owned before the project.

After full payment, the customer receives the right to use the completed website design and project-specific content for their business, subject to hosting requirements, third-party licenses, platform limitations, reusable components, template rights, software rights, and these Terms & Conditions.

Painter Website Pros, Evergreen Web Solutions, and their providers retain ownership of internal processes, reusable systems, template frameworks, development methods, software, tools, code libraries, design systems, general techniques, materials not created exclusively for the client, and unpurchased preview concepts.

Template and semi-custom websites may use similar layouts, structures, widgets, section styles, or design components as other websites.

Unless specifically stated in a signed agreement, website packages do not include complete ownership of all source code, platform code, software, tools, systems, or third-party technology.

18. Preview Ownership and Prohibited Use

Free previews remain the property of Painter Website Pros unless and until the applicable package is purchased and paid for.

Preview access is provided only for evaluation.

A prospect may not copy the design, text, layout, screenshots, graphics, structure, page concept, or visual direction for another provider to reproduce.

A prospect may not publish the preview as a live website, remove branding or access controls, transfer the preview, resell the preview, or misrepresent the preview as a completed website they own.

Painter Website Pros reserves the right to revoke preview access if the preview is misused.

19. Portfolio Rights

Unless the customer requests otherwise in writing, Painter Website Pros and Evergreen Web Solutions may identify the customer and display the completed website, screenshots, logo, general project description, and non-confidential project details in portfolios, proposals, social posts, case studies, website examples, and marketing materials.

Confidential information should not be displayed.

A customer may request that a project not be publicly featured. Painter Website Pros will make reasonable efforts to honor written requests not to feature a project publicly.

20. Hosting and Website Management

Hosting is required after launch for Painter Website Pros website packages.

Standard hosting currently starts at $75 per month.

The exact included services are described in the applicable package, proposal, invoice, or agreement.

Hosting and website management may include website availability, security measures, platform updates, backups, monitoring, support, and reasonable small edits, depending on the selected plan.

Hosting is not a guarantee that the website will never experience downtime, errors, security incidents, data loss, form issues, plugin issues, platform issues, or third-party outages.

Major redesigns, new pages, custom functionality, extensive copy changes, large content uploads, advanced integrations, new service-area structures, or major strategy changes are not automatically included as small edits.

Unused support time, edits, or maintenance work do not roll over unless stated in writing.

Hosting fees may change after at least 30 days’ written notice.

21. Hosting Cancellation

Customers may cancel hosting or website-management services with at least 30 days’ written notice.

Cancellation should be submitted by email or another documented written method.

Fees already due remain payable.

Cancellation does not automatically include migration, recreation, export, rebuilding, redesign, or setup on another platform.

Domain ownership remains with the customer.

Continued operation of the website after cancellation may depend on the platform, third-party services, licenses, hosting structure, and migration options available.

Third-party services may need to be transferred, replaced, reconnected, or separately purchased.

Customers should request any available files, account details, or transition assistance before service ends.

Additional migration, transition, rebuilding, export, or setup work may be quoted separately.

Painter Website Pros does not guarantee that a hosted website can always be transferred exactly as built.

22. Suspension or Termination

Painter Website Pros may suspend or terminate services for reasonable causes, including unpaid invoices, fraud, abusive conduct, security threats, illegal material, intellectual-property violations, spam, malware, prohibited content, misuse of platform resources, repeated agreement violations, or conduct that creates risk for Painter Website Pros, Evergreen Web Solutions, clients, users, or service providers.

Whenever practical, reasonable notice may be given before suspension.

Immediate action may be taken when necessary for security, legal, payment, platform, or operational reasons.

Suspension or termination does not eliminate payment obligations for services already provided, fees already due, or approved expenses already incurred.

23. Acceptable Use

Users and customers may not use the website, previews, completed websites, hosting, or related services to:

  • Break the law
  • Infringe copyrights or trademarks
  • Publish knowingly false or fraudulent information
  • Distribute malware
  • Attempt unauthorized access
  • Send spam
  • Harass others
  • Collect information unlawfully
  • Interfere with website security
  • Misrepresent licenses or credentials
  • Host prohibited, dangerous, deceptive, or unlawful material
  • Abuse platform resources
  • Interfere with the operation of the website or services

Painter Website Pros may remove or restrict material that violates these rules or creates legal, security, platform, or business risk.

24. Third-Party Platforms and Services

Projects may depend on independent providers such as domain registrars, hosting infrastructure, website software, Google, analytics providers, email providers, text-message systems, payment processors, scheduling tools, social networks, review platforms, embedded applications, and other third-party services.

Painter Website Pros is not responsible for third-party outages, pricing changes, policy changes, account suspensions, discontinued features, API changes, search-engine changes, registrar delays, platform limitations, or problems caused by client-controlled accounts.

Use of third-party platforms is governed by the provider’s own terms, privacy policy, and account rules.

Customers may be responsible for maintaining third-party accounts, paying third-party fees, keeping login information secure, and complying with third-party requirements.

25. No Guarantee of Business or Marketing Results

Painter Website Pros does not guarantee search-engine rankings, Google placement, website traffic, phone calls, form submissions, leads, sales, revenue, conversion rates, customer reviews, business growth, return on investment, approval by Google or another platform, or uninterrupted website availability.

Results depend on many factors outside Painter Website Pros’ control, including competition, market demand, pricing, reputation, service quality, customer follow-up, advertising, client responsiveness, project photos, reviews, search-engine changes, and broader market conditions.

Website examples, testimonials, case studies, previews, and past results are not promises of identical future outcomes.

26. Website Accuracy and Legal Compliance

Customers are responsible for ensuring their website complies with laws and industry requirements that apply to their painting business.

This may include licensing disclosures, insurance claims, advertising rules, warranty statements, promotions, privacy requirements, accessibility obligations, text-message practices, email marketing, consumer-protection requirements, and industry-specific disclosures.

Painter Website Pros may provide general website and marketing assistance, but we do not provide legal, accounting, insurance, licensing, tax, or regulatory advice.

Painter Website Pros does not guarantee that a website is legally compliant in every state, county, city, industry, or jurisdiction.

Customers should consult qualified professionals when legal, licensing, insurance, tax, regulatory, or accessibility questions apply to their business.

27. Accessibility

Painter Website Pros aims to build websites using reasonable modern design, usability, and accessibility-aware practices.

Accessibility requirements can vary based on the business, jurisdiction, content, integrations, platform, ongoing changes, and legal standards that may apply.

Unless expressly included in the project scope, the service does not guarantee certification or complete compliance with every accessibility standard.

Customers who require a formal accessibility audit, remediation program, compliance certification, or legal assessment should obtain specialized professional assistance.

28. Warranties and Disclaimers

The website and general information are provided on an “as available” basis.

Painter Website Pros will provide services with reasonable professional care.

Except for promises expressly included in a written agreement, Painter Website Pros does not make additional warranties about the website, previews, services, hosting, third-party tools, business results, rankings, traffic, leads, sales, or uninterrupted availability.

No website, hosting system, security measure, email system, form system, software platform, or third-party tool can be guaranteed to be error-free, uninterrupted, or completely secure.

Draft previews may contain incomplete, placeholder, or temporary material.

Nothing in these Terms & Conditions is intended to disclaim obligations that cannot legally be disclaimed.

29. Limitation of Liability

To the maximum extent permitted by law, Painter Website Pros and Evergreen Web Solutions are not responsible for indirect, incidental, special, consequential, exemplary, or lost-profit damages.

This includes losses related to third-party platforms, outages, customer content, inaccurate information supplied by the customer, unauthorized account access caused by customer credential practices, search-engine changes, missed business opportunities, reduced traffic, lost leads, lost revenue, or the customer’s failure to maintain accounts, domains, payments, or third-party services.

Total liability arising from a particular paid service will not exceed the amount paid by the customer to Painter Website Pros for that specific service during the six months immediately preceding the event giving rise to the claim.

Some jurisdictions may not allow certain limitations of liability, so some limitations may not apply in all situations.

30. Indemnification

A customer may be responsible for claims, damages, losses, expenses, or disputes arising from:

  • Materials the customer submitted without permission
  • False or misleading business claims supplied or approved by the customer
  • The customer’s unlawful use of the website or services
  • The customer’s violation of another party’s intellectual-property rights
  • The customer’s violation of another party’s privacy rights
  • The customer’s violation of these Terms & Conditions
  • The customer’s misuse of third-party platforms or accounts

This responsibility applies only to the extent the claim arises from the customer’s materials, actions, approvals, omissions, or violations.

31. Force Majeure

Painter Website Pros is not responsible for delays or inability to perform caused by circumstances outside its reasonable control.

These circumstances may include natural disasters, wildfires, severe weather, power failures, internet outages, cyberattacks, platform outages, government actions, labor disruptions, illness, emergencies, third-party provider failures, registrar issues, or other events beyond reasonable control.

Painter Website Pros will make reasonable efforts to resume work when practical.

32. Governing Law and Venue

These Terms & Conditions are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

Unless otherwise required by applicable law or agreed in writing, legal proceedings relating to these Terms & Conditions will be brought in the state or federal courts serving Chelan County, Washington.

33. Informal Dispute Resolution

Before filing a legal claim, each party should make a good-faith effort to resolve the issue informally.

A party should provide written notice describing the issue, the relevant project or service, and the requested resolution.

Both sides should attempt to resolve the issue through good-faith communication for approximately 30 days before filing a claim, unless urgent injunctive relief or immediate legal action is reasonably necessary.

34. Changes to These Terms

Painter Website Pros may update these Terms & Conditions when services, pricing structures, platforms, laws, tools, or business practices change.

When these terms are updated, the “Last Updated” date will be revised.

Changes apply prospectively from publication unless otherwise stated.

Material changes affecting active recurring services may be communicated separately when appropriate.

A project already governed by a signed agreement remains subject to that agreement unless both parties agree to modify it.

35. Severability

If one part of these Terms & Conditions is found invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid or unenforceable provision should be interpreted or modified to achieve its intended purpose as closely as permitted by law.

36. No Waiver

If Painter Website Pros does not immediately enforce a provision of these Terms & Conditions, that does not permanently waive the right to enforce that provision later.

A waiver must be in writing to be effective.

37. Entire Agreement

These Terms & Conditions, together with the Privacy Policy and any accepted proposal, invoice, service agreement, or project-specific written terms, form the applicable agreement between the customer and Painter Website Pros.

Project-specific signed terms control when they directly conflict with these general website terms for that specific project.
